I.F. man arrested for rape


An Idaho Falls man was arrested after he reportedly raped and impregnated a woman.

Rocky Leon Joe, 51, was arraigned Friday for rape where the victim is prevented from resisting by infliction of bodily harm, intoxicating substance or an anesthetic.

The victim reported Joe in November 2016 while she was incarcerated at Bingham County Jail. A deputy contacted the Idaho Falls Police Department after the victim reported the rape, according to court records. The deputy informed the department that the victim was 10 weeks pregnant.

The victim told an Idaho Falls Police Officer that Joe had met her on the street and asked her if she needed a place to go. Joe took the victim to his residence, where she fell asleep. The victim, who was intoxicated when she left with Joe, said she woke up three times to find Joe on top of her.

The victim told officers she hadn’t reported the incident sooner because there was a felony warrant for her arrest. A no-contact order has been filed between Joe and the victim.

Joe told investigators he had brought the victim home because she had nowhere to stay and that nothing sexual happened between them.

The victim later gave birth to the baby. A DNA test performed by the Idaho State Police Forensic Services found there was a 99 percent chance Joe was the biological father, according to court records.

Rape is punishable with a minimum of one year in prison and up to a life sentence.

A no-contact order hearing is scheduled for 9:30 a.m. Feb. 21. A preliminary hearing is scheduled for 1:30 p.m. Feb. 23.
